Aug 31Well Randy had court this morning and it definitely did not go as planned. Background: He met Carrie in Aug of 06. They got married Oct 06, they split before Thanksgiving 06. She got knocked up by another guy mid Dec 06.
In Jan 07 she filed a spousal support petition and he was supposed to go to court in July of 07 for the ruling. Being in a halfway house, he didn’t. He could’ve been granted permission to leave, done it over the phone, etc.. but he didn’t. They defaulted against him for the amount of $75/week. He got this notice in prison which he was in from Nov 30, 07 until Dec 1, 08. He ended up filing a paternity petition while in to contest that along with a divorce, which never went through due to the paternity issue taking months to resolve. He filed AGAIN for divorce in Dec 08 and it was finally granted in June of 09.
According to the judge, when the divorce was finalized the order was nullified. Since he didn’t file a petition before this time period he is responsible for retroactive spousal support from the period of Jan 07 until May of 09 which is close to 2 1/2 years. At $75/week, it adds up real quick. Nevermind that she had a kid by another man. Or that he never worked once during the entire marriage or relationship whatsoever. Or that he was serving time in prison for a year. Because he didn’t go to court 1 day he is expected to pay that stupid cunt bag over $10,000 for being a whore.
Thanks NY. You really make a lot of fucking sense. She tried saying today they were still married and we had to get an adjournment for 1/2 hr to go pay $12 to get a copy of the divorce from the clerk there. We also had to drive an hour and a half each way to the court house. Poor little Carrie, the victim. She was saying on the way out “I still get money” to someone. It pisses me off because we’re struggling as it is and now she is getting his hard earned money when she doesn’t deserve a goddamned penny of it, especially considering the circumstances. There is nothing he can do to appeal it either because he didn’t show up for court that 1 day (which was 2 1/2 hours away from the HH but that doesn’t matter either apparently).
Honestly all I can say is this sounds like absolute craziness. What a mass of confusion. I think if he was in jail he shouldn’t have to pay for that time period and if she wasn’t working why would he have to pay it to begin with? She should get off her lazy ass and work. *sigh*. I’m sorry
Unfortunately missing a day of court can kill you. My ex-husband says constantly that he has to pay too much child support but I just put on the papers what he TOLD ME he could afford. Then the day of the court hearing, he didn’t show up and the court granted me what I asked for as a default judgment.
Hopefully Randy learned from that mistake and takes all the future court dates REALLY seriously.
He does now Anna. It was during that period when he was screwing around with the halfway house. He’s been to court numerous times while in prison and multiple times since he’s been out.
Live and learn I guess. I’m trying to just accept it and get over it since we can’t change it. Child support I’d get but this just chaps my ass b/c she doesn’t deserve a dime.
Once it’s done though that will be the end of everything. A hard lesson learned.
It does seem to be a hard lesson learned. Some people take advantage of certain situations and it’s pretty unfortunate that it has to be people you trusted the most at one point in your life. Things will only get better.
Ughhhh. I read this earlier but didn’t comment since I was at work. She just REALLY pisses me off. Ten. Thousand. Dollars. Kick her in the balls. I just hope you get to pay this over time, $75/week, instead of a lump sump.
It’s just ridiculous considering you need ALL of that money he is earning right now, and he has a right to it, and she has NO claim.

God, I’m sorry someone is doing their best to be so ridiculous.
Bad times in life happen, but he can’t put the blame of this on anyone but himself. Thinking otherwise is just trying to find a scapegoat for messing up. Court dates are extremely serious. This just again proves that point.
It sucks, and she is obviously doing it out of spite to begin with, but if he had shown up to that one court date, this wouldn’t have happened. We all learn from our mistakes.
This really sucks. Is there anyway to petition the ruling, maybe get it reduced due to extenuating circumstances?

I said it on Twitter, but I’ll say it again…this is completely ridiculous. Yes, I understand he missed the court date, and that was not a good thing to do, but come on…Here in GA, you have to be married 5 years before you will be granted any spousal support/alimony when you divorce.
Also, the fact that she got pregnant by someone else should say something about how serious she took the marriage, and how she doesn’t deserve any money from Randy. I’m guessing she’s getting child support too? She may make enough off the two men to not have to work…*eyeroll*
